Charging Fees in Tribunals

Following a consultation by the Ministry of Justice, the results have been published and are intended to be implemented in summer 2013.

The key charges are;

  • A £160 'issue fee' for straightforward cases (such as unlawful deduction from wages) known as 'level 1' cases, rising to £250 for more complex 'level 2' cases.
  • A 'hearing fee' of £230 for level 1 cases and £950 for level 2 cases.
  • A £400 issue fee and £1,200 hearing fee in the Employment Appeal Tribunal.
  • A £600 fee for a judicial mediation.
  • A £60 fee for an application to dismiss following settlement.

The Ministry of Justice's press release states that these fees would contribute towards (but not entirely cover) the £84m cost of running the employment tribunal system and that the government intends to review the fee structure following its implementation.
